Kitty Williamson sued Orkin Exterminating Company (Orkin) under theories of common law negligence and violations of the Deceptive Trade Practices Act (DTPA) for damages resulting from Orkins application of chlordane, a pesticide, to Williamsons house. In addition to finding liability on both theories, the jury made findings of actual damages, attorneys fees, and exemplary damages. The trial court disregarded the jurys finding as to one element of actual damages, about which Williamson does not complain, and rendered judgment for Williamson on the remainder of the jurys verdict. We will affirm the trial courts judgment.
